刑法第第一百八十五條之三條文修正草案
案由：本院楊委員麗環等 人，有鑑於目前酒駕刑責雖已於100年11月修法, 但仍不足以嚇阻酒駕行為，爰提案修訂「刑法第第一百八十五條之三條文修正草案」加重酒駕刑責。是否有當，敬請公決。
說明：
鑑於現行酒駕刑責雖已於民國100年11月修法通過，但仍不足以嚇阻酒駕行為。在所有公共危險罪當中，因酒駕緻人於死或重傷是公共危險罪當中，罰責最輕的。酒駕行為屬故意論，此罰責過輕，無法對駕駛人產生嚇阻效果。是以，應將酒駕行為視以故意論之，而非過失論。

第185之3條（重大違背義務緻交通危險罪） 服用毒品、麻醉藥品、酒類或其他相類之物，不能安全駕駛動力交通工具而駕駛者，處五年以下有期徒刑、拘役或併科二十萬元以下罰金。
因而緻人於死者，處無期徒刑或七年以上有期徒刑；緻重傷者，處三年以上十年以下有期徒刑。
