新澳門學社聲明
就最近再有網民發佈訊息被捕而由檢察院發還案件重新調查一事，新澳門學社發表聲明如下：
1. 人人有自由發表意見的權利；此項權利包括尋求、接受和傳遞各種消息和思想的自由，而不論國界，也不論口頭的、書寫的、印刷的、採取藝術形式的、或通過他所選擇的任何其他媒介。在並無顯著跡象觸犯法律的情況下，把發表意見者拘捕指控，對當事人造成困擾，是濫用警權，侵犯言論自由。
2.. 新澳門學社強烈讉責司警濫用警權，嚴重侵犯網民的言論自由。從本案被發還調查中得知，司警在缺乏證據的前提下，向傳媒高調披露有網民因發言被捕。此舉除對報導事實、發表批評及暴露社會不公的網民構成威嚇外，亦有對互聯網的批評聲音產生「殺一儆百」的效果。
3.本澳涉及互聯網討論區的案件當中，特別是連續多次發表要在大型活動及公共場所放置炸彈的言論，該類案件明顯有危害公共安全及影響社會穩定的意圖，性質嚴重，但警方到目前仍未將任何涉案人士送到檢察院，反而就故意草率地將本案的事主高調送到察檢院指控。警方的辦案及判斷能力實在令人憂慮。
4. 在金融海嘯之下，人心虛怯，特區政府須加強監管高風險投資工具營銷手法，加強監管代客買賣金融產品服務，加強監管保險及銀行業風險，以及設置穩定的存款保障機制，以回應挑戰，維護金融制度，而濫用警權壓制資訊流通和言論發表，只會加深不明朗和恐懼，實不利於維護社會穩定，亦不利於維護金融制度穩定。
5.在公德層面，新澳門學社亦呼籲，市民應認清在發表言論時的權利和責任，培養理性文明的討論文化及培養尊重異見的精神。
New Macau Association’s Statement
New Macau Association, NMA thereafter, issues the following statement on the arrest of a netizen posting information and the Procuratorate’s return to further investigation:
- Everyone has the right to express themselves freely; which includes the right to seek, receive and spread information and thoughts of all kinds, whether it is oral, written, printed, artistic, or any other one chooses. Under the condition one has not obviously broken the law, putting the person who expresses his/her views under arrest, thus causing disturbance to the party, is a misuse of the police power, and a breach of the freedom of speech.
- NMA strongly condemns the misuse of police power by the Judicial Police, gravely violating netizens’ freedom of speech. Based on the fact that the case has been returned to further investigation, the JP has announced its arrest while there is a lack of evidence. This is not only a threat to those netizens who report facts, express criticism, and expose social injustice, it is also to slay somebody as warning to other criticisms on the Internet.
- Among those cases concerning Internet forums, those consecutive speeches declaring bombs to set in public places and major events obviously contain intent to threaten public safety and social stability, bearing a critical nature. At the moment, however, the police have not sent any person to the Procuratorate, but they send the party concerning this case to the Procuratorate in a well-publicized manner. The police’s ability in handling cases and making judgment is worrying.
- People lack confidence under the Financial Tsunami. The Macau SAR government should strengthen its supervision on high-risk investment apparatus, agency service, the risk of the banking and insurance industries, and establish a stable deposit protection to face the challenge and defend the financial system. The misuse of the police power by suppressing information flow and speech expression only deepens uncertainty and fear, and does no good for social and financial stability.
- As for public morality, NMA appeals that the public should understand their rights and responsibilities on their speech, and cultivate a discussion culture of based reason, culture and respect to different opinions.
